Caveat Emptor

I ordered a camcorder from a company called MyDv a couple of weeks ago. They promise fast, free delivery. Indeed, their website offers this promise:

“Fast, Reliable & FREE Shipping.”

After a week, I contacted them using their on-line chat facility and was told it would take a further 5 – 7 days. Yesterday, I tried again. I was told that it should have been despatched on the 2nd November, however, I had better check back on Monday because the operator was unsure and couldn’t access the information for despatches on the 2nd. By now, I was starting to worry. This morning I did a bit of research and the outcome isn’t good. Kelkoo merchant reviews offers a litany of similar stories to mine.

Before getting back to MyDv to pursue the matter further – and cancel the order if the goods had not already been despatched, I gathered all the relevant information together. That’s when I realised that my credit card had been charged £202.26 instead of the invoiced £189.99. So was I being charged for deliver after all? No, it would appear not.

It seems that this is not, as advertised, a UK company, but one based in the USA, despite having a UK address and phone number on the website. The difference in price is caused by currency fluctuation. However, they price in UK£, therefore, any fluctuation should be their problem not mine. Indeed, invoicing one price and charging another is illegal. Also, the low prices quoted are based upon non UK taxed prices – that’s why they are so reasonable.

I suspect that my camcorder is being increasingly delayed due to it not being in stock – they just aren’t prepared to say so. This morning I was told that it would be another week, confirming my suspicion. I list the chat transcript I had with “Lisa” this morning:

Mark: I wish to discuss my order, ****, please
Mark: I placed this order on the 23rd October. Apparently, it should have been shipped on the 2nd November. This is bad enough – that two weeks after placing the order, I still do not have it. I discover that you have charged my credit card account £12.26 more than the invoiced amount.
Lisa: Your shipment date is moved for a few days.however youy should get it in about a weeks time
Mark: Please cancel this order and refund my money in full. This is £202.26
Lisa: THe amount that you were overcharged will be refunded
Mark: No, I want to cancel the order and be refunded the whole amount – please confirm this.
Lisa: We can get your money refunded, that shouldnt be a problem
Mark: Okay – do you need a fromal cancellation letter?
Mark: Do you need me to send you a letter?
Mark: Hello?
Lisa: No you dont require one just call on the customer service number
Mark: Okay. Thankyou.

When I called the number mentioned by Lisa this morning, they were open about being US based and I don’t have a problem with that providing they are up front on their website about it, and price in US$. That way, currency fluctuation isn’t an issue. I spoke to two people both of whom told me that my order would be with me in about a week. I repeated my determination to cancel the order and made my displeasure plain. They finally agreed to cancel the order and provide a full refund. We will see what happens. I did point out that pissing off one’s potential clientele by lying to them was not a good business model, but I doubt that will have any effect other than assuaging my own irritation – not least for getting caught out.

I bought the camcorder locally and paid more for it, but la vie c’est comme ça It’s not often that my inbuilt sense of cynicism fails me…

This is one to avoid, I think. Caveat Emptor, indeed.

  1. Reading your comments is like Deja Vous. I also bought a comcorder from MyDV and as you was over charged and have never received it. I phoned today to cancel the order and had some difficulty with this. They kept stating I should get my camcorder within the next 7 days. However I insisted on canceling the order and was told it would take 5-7 days to be refunded. When I asked why it would take so long they stated that was the alloted time for refunds and when i asked to be transferred to the finance department i was told they do not have a phone number.
    I now await with sceptical breath and am inclined to face the fact they will not pay up.

  2. Same for me too. I ordered a camera got charged £12 over. Ive tryed to cancel, it doesnt seem to be going anywhere. What time did you ring? As all i get is ‘message box full’ when i try. I am now forced to drop my Alevel photography course as i cant raise funds to buy another (i sold my original one to pay for this). Im more annoyed that they cost me my future than my money. Please can you contact watchdog, if enough of us do, theyll do something about it surely? Heres hoping. Jtx

  3. hi this is so bad i was wripped off on ebay and swore i would not buy online again, i bought a psp for my sons xmas pressie on 8th november they said it would be shipped on 21st and i would receive an email confirming this. i have received nothing i have emailed them twice and keep ringing the no. i really do not no what to do, how do i get in touch with them please can somebody help.

  4. Having booked a romantic holiday for my partner and I to Rome, I decided a digital camera was needed. I ordered a Sony Cybershot camera from MyDv on 7th Novemeber after having been on the “live” chat. I was promised by Sandra that the item was in stock and would be delivered max 10-14 days. The price £112.99. 3 days later i checked my credit card bill and they’d charged me $206.04, which was £122.04. I emailed them without reply. A couple of days later I went “live” chat again and was assured I would get my order and that she (Lisa) would put in a ‘special’ request for speedy delivery. I honestly wasnt that worried about the overcharge as long as i got my order. After 10 days I became worried and several un answered emails later, I again went “live”. I was told again not to worry. The next day I recived an email stating my shipment was due on 21st Nov and that they would email me my tracking number, but no reply on the overcharge. At this point I became suspicious and the 21st came and went. The 22nd I emailed.. still no response. So today I went live to cancel (as I found millions of bad threads about them!!) I went live and was told by Lisa you have to cancel by calling 02079934698. So i logged off and to my surprise was greeted by an automated FULL voice box. Grr.. I went live again and sternly took no crap. I told Lisa I was cancelling and almost instantaniously a pre written pile of rubbish regarding poor manufacturing supply appeared. Again I said, tough I want to cancel and the phone line is a waste of time. After a little persistance she accepted and said she would cancel online and I would recieve a confirmation email within a couple of hours. I put the phone down uncertain. Having read more horror stories of other people’s experiences I turned to a number found on MATRIX WATCH. This contact number works!!!!!

    I spoke to sebastian who tried fobbing me off with the prospect of a delivery already sent and a restocking fee. I simply told him the concersation was being recorded and that under the sales of goods act 1976 I was cancelling without penalty. He then transfered me to the finance dept who cancelled the order and said I will reieve a refund in 7-10 days. I also complained about the overcharge and she took down the sum to be repaid. Shortly after I recieved an email confirming their sadness at my cancellation!
    Fingers crossed the money will go in, and god only knows if the overcharge will be paid back. We should all stick together and purse these con artists.

    Also been scamed aparently, I ordered a £99.99 Ipix digi cam but when I checked thay had invoiced me for that plus a duplicate £99.99 with with different £199.99 camera thrown into ther mix, so all in i’m over £400 down.
    Voice mail box full, no replies to e mails etc.
    From a call to my card Co. who has recieved many complaints from customers about this company, I found out I had also been charged extra (for shipping I thought).

    I will try the other number provided by john and see where that gets me.

    I’ll also contact watchdog.

  6. i bought 2 psp’s yesterday then realised it was a fraud website, i paid 367.00 for kids xmas presents, been in to my bank and they told me to ring and stop my debit card, so hopefully no money should be taken.

  7. I am in the process of cancelling an order with MYDV for a camera which has never turned up. It was my husbands 50th birthday present, but after numerous telephone calls I was told the camera was lost. They also overcharged me by £25.45 which I did get back without any hassle, so I’m hoping that I will get my £319.00 returned as quickly.

  8. I order a mini ipod from mydv and i am desperately trying to contact them. I was told my order will be delivered by Xmas but this doesnt seem likely now. The chat line doesnt work and no one replies to your emails, oh yes and the phone mailbox is full. What sort of company is this.
